1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and ArticleAudio ("Company," "we," "us," or "our") governing your access to and use of the ArticleAudio browser extension, website, and related services (collectively, the "Service").
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date above. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
2. Description of Service
ArticleAudio is a browser extension that provides AI-powered text-to-speech functionality. The Service allows you to convert text you select, readable full-page content you ask ArticleAudio to process, and supported-site content you explicitly choose into natural-sounding audio using speech synthesis technology.
For full-page listening, the Service may extract readable text and limited page metadata, including the page title, byline, excerpt, site name, and URL, and send that information to our servers and AI providers to prepare the content for narration. Long selected text may also be summarized when you explicitly choose the summary option.
The Service is designed to assist users in consuming written content through audio format. We continually work to improve and expand our Service, and we may add, modify, or discontinue features at our discretion.
3. Eligibility
You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and the organization.
4. Account Registration
To access certain features of the Service, you may need to create an account or provide your email address. You agree to provide accurate, current, and complete information and to keep this information up to date.
You are responsible for maintaining the confidentiality of your account credentials and license key. You agree to notify us immediately of any unauthorized access to or use of your account.
5. Subscription Plans and Pricing
5.1 Free Plan
Free users receive a one-time allocation of 1,000 words for text-to-speech conversion. This allocation does not reset or renew. Once exhausted, you must upgrade to a paid plan to continue using the Service.
5.2 Pro Plan
The Pro plan provides unlimited word conversion for a monthly or annual subscription fee, subject to our Acceptable Use Policy and fair-use requirements. Pro subscribers also receive higher-quality audio output and priority customer support.
Pro subscriptions are intended for normal, individual use through the official ArticleAudio browser extension. They are not intended for automated, scripted, bulk, resale, shared, or commercial API-style usage unless we have provided prior written authorization.
5.3 Pricing Changes
We reserve the right to modify our pricing at any time. Any price changes will be communicated to you in advance and will apply to subsequent billing cycles. Your continued use of the Service after a price change constitutes acceptance of the new pricing.
6. Payment Terms
All paid subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). Payment is due at the time of subscription and at each renewal period.
We use third-party payment processors to handle all transactions. By providing payment information, you authorize us to charge your selected payment method for all applicable fees.
All fees are non-refundable except as expressly set forth in our Refund Policy.
7. License and Usage Rights
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes.
Upon purchasing a Pro subscription, you receive a license key that allows you to use the Service. Each license may be activated on up to three (3) devices or browsers simultaneously.
You may not share your license key publicly, sell, rent, lease, or transfer it to others, or use it in violation of these Terms.
8. Acceptable Use Policy
You agree not to:
- Use the Service for any illegal, harmful, or fraudulent purpose
- Violate any applicable laws, regulations, or third-party rights
- Attempt to circumvent usage limits, licensing restrictions, or security measures
- Access or attempt to access non-public APIs, endpoints, infrastructure, or backend services except through the official ArticleAudio browser extension or other interfaces we expressly provide
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
- Use automated systems, bots, scripts, crawlers, batch processors, or other non-human workflows to access the Service, generate audio, or consume excessive resources without our prior written authorization
- Submit unusually high-volume, repetitive, machine-generated, or programmatically collected text in a way that places disproportionate load or cost on the Service
- Share, pool, rotate, or otherwise use account identifiers, user IDs, license keys, devices, or credentials to avoid usage controls or enforcement
- Resell, redistribute, sublicense, or commercialize the Service without our written authorization
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to our systems or networks
- Use the Service to generate audio for content that is defamatory, obscene, or infringes intellectual property rights
We may monitor usage patterns, request additional information about unusual or excessive usage, apply rate limits or other technical controls, and suspend or terminate access where we reasonably believe usage violates these Terms, creates security risk, or imposes disproportionate cost or operational burden on the Service.
9. Intellectual Property Rights
The Service, including its design, code, features, functionality, and content, is owned by ArticleAudio and is protected by copyright, trademark, and other intellectual property laws.
You retain all rights to the text content and page information you submit for conversion. We do not claim ownership of your content. By asking ArticleAudio to read selected text, supported-site content, or a full page, you grant us a limited license to extract, transmit, prepare, summarize when requested, synthesize, and otherwise process that content solely to provide and operate the Service.
To provide the Service reliably and avoid repeating identical processing, prepared narration text, summaries, and generated audio may be temporarily cached for up to 2 days before automatic deletion. Additional information about our processing and service providers is available in our Privacy Policy.
You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
10. Third-Party Services
The Service may integrate with or rely on third-party services, including AI speech synthesis providers, page-preparation and summarization providers, analytics providers, and payment processors. Content is shared with these providers only as needed to provide the requested feature, operate the Service, or fulfill the purposes described in our Privacy Policy. Your use of such third-party services is subject to their respective terms and policies.
We are not responsible for the availability, accuracy, or content of third-party services, and we do not endorse or assume liability for any third-party products or services.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE SERVICE AT YOUR OWN RISK.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARTICLEAUDIO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
13. Indemnification
You agree to indemnify, defend, and hold harmless ArticleAudio and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of any third party.
14. Termination
You may terminate your use of the Service at any time by discontinuing use and, if applicable, canceling your subscription.
We may suspend or terminate your access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, us, or third parties, or for any other reason.
Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
16. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
17. Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and ArticleAudio regarding your use of the Service and supersede all prior agreements and understandings, whether written or oral.
